Early Retirement Pension Through Court

Employees who have worked for many years in hazardous or arduous working conditions are entitled to early retirement benefits. This right is guaranteed by the legislation of Ukraine and applies to individuals whose occupations are included in List No. 1 and List No. 2 of industries, jobs, professions, and positions involving hazardous or arduous working conditions. In practice, however, exercising this right is often difficult because the Pension Fund of Ukraine (PFU) frequently refuses to grant a pension or declines to include certain periods of employment in the preferential employment record. In such cases, court proceedings often become the only effective way to protect an individual's rights.

An early retirement pension is granted to individuals who have accumulated the required general insurance record and the necessary period of employment in hazardous or arduous working conditions. These categories include employees of mines, metallurgical enterprises, chemical plants, power generation facilities, and other industries where work is associated with increased health risks. A special category of early retirement benefits is the miners' pension, which provides specific retirement conditions for employees engaged in underground work.

Despite having proper entries in their employment records and other supporting documents, many applicants receive refusals from the Pension Fund. Common reasons include the absence of a preferential employment certificate, liquidation of the employer, loss of archival records, inaccuracies in employment documents, and similar issues. These problems are especially common for individuals who worked at enterprises located in temporarily occupied territories or companies that ceased operations many years ago. As a result, people who have in fact accumulated sufficient preferential employment service are often forced to prove their entitlement to a pension through court proceedings.

Court practice demonstrates that employment record books, archival certificates, hiring and dismissal orders, payroll records, personal employment files, and other documentary evidence may serve as sufficient proof of preferential employment service. Therefore, the absence of a specific certificate does not necessarily mean that a person has no legal right to an early retirement pension.

Another important category of pension disputes concerns the inclusion of periods of education and military service in the preferential employment record. In many cases, the Pension Fund refuses to recognize these periods when determining eligibility for an early retirement pension based on hazardous working conditions. Nevertheless, Ukrainian courts frequently rule in favor of applicants and declare such refusals unlawful.

Obtaining an early retirement pension through court proceedings makes it possible not only to overturn an unlawful decision of the Pension Fund but also to oblige the competent authority to reconsider the application or grant the pension from the date on which the applicant became legally entitled to receive it. In addition, after obtaining a favorable court judgment, individuals are often entitled to receive pension arrears accumulated as a result of the unlawful refusal or incorrect pension calculation. Thus, judicial protection enables applicants to fully restore their violated pension rights.
