Early Pension for Parents of a Child with a Disability in Ukraine
Under the general rules, entitlement to an old-age pension in Ukraine depends on reaching the statutory retirement age and having the required insurance record. However, Ukrainian legislation provides certain exceptions that allow specific categories of persons to retire earlier. One such ground may be raising and caring for a child with a disability.
Raising a child with a disability may require parents to devote considerable time to the child’s care, which can significantly affect their ability to work and earn an income. Ukrainian pension legislation therefore provides special retirement guarantees for parents who meet the statutory requirements. An important issue in determining entitlement to such a pension is whether the child’s medical condition corresponding to disability arose before the child reached the age specified by law.
This issue was considered by the Grand Chamber of the Supreme Court in case No. 330/2181/16-a. The Court clarified the conditions under which a parent may qualify for early retirement in connection with raising a child with a disability.
Ukrainian pension legislation provides special conditions for mothers who have raised a child with a disability to the age prescribed by law. Subject to the applicable statutory requirements concerning age and insurance record, such a mother may qualify for an early old-age pension. Periods of caring for a child with a disability may also be relevant when determining the person’s insurance record in accordance with the applicable legislation.
The Supreme Court has also addressed the possibility of granting an early pension to the father of a child with a disability. An important condition is confirmation that the child had a medical condition corresponding to disability before reaching the relevant statutory age. Where disability was formally established later, including after childhood, entitlement may depend on medical evidence confirming that the relevant condition existed during the required period.
The Court emphasised that, when determining entitlement to an early pension on this ground, particular importance should be attached not only to the date on which disability was formally established but also to the time when the medical condition corresponding to the statutory criteria for disability actually arose.
Accordingly, medical documentation confirming that the child had the relevant medical indications during the period required by law may be crucial when applying for this type of early pension. Where the Pension Fund refuses to grant an early pension despite sufficient evidence confirming the relevant circumstances, such a decision may be challenged before an administrative court.
The judgment of the Grand Chamber of the Supreme Court in case No. 330/2181/16-a provides important guidance for resolving disputes concerning early retirement for parents who have raised a child with a disability.
