Pension Disputes and Court Proceedings in Ukraine

In practice, applicants may encounter unlawful decisions, actions, or inaction by the Pension Fund of Ukraine that prevent them from exercising their legal right to receive a pension. However, a negative decision of the Pension Fund does not necessarily mean that the matter is over. Ukrainian legislation provides legal mechanisms for challenging such decisions and protecting pension rights. If a pension dispute cannot be resolved through pre-trial procedures, our lawyers can assist with bringing the matter before the court. Pension disputes with the Pension Fund of Ukraine are generally considered within administrative court proceedings.

The first stage of court proceedings is the preparation and filing of a statement of claim.

A statement of claim is a procedural document submitted by a claimant to the court in accordance with the requirements established by procedural law. It contains the claimant's demands for judicial protection and restoration of violated rights or legitimate interests. In a typical pension dispute, the client acts as the claimant, while the relevant authority of the Pension Fund of Ukraine acts as the defendant.

Proper preparation of the statement of claim is particularly important because the outcome of the case may depend significantly on how clearly the relevant circumstances, evidence and legal arguments are presented to the court. Before preparing a lawsuit against the Pension Fund of Ukraine, our Pension Center lawyer collects and analyzes the necessary documents, prepares electronic copies where required, and explains the proposed litigation strategy to the client. Information and documents concerning the client's previous applications and correspondence with the Pension Fund are also examined.

Taking all relevant circumstances into account, we prepare a statement of claim explaining who the claimant is, why judicial protection is required, which decision, action or inaction of the Pension Fund violated the claimant's rights, which rights were affected, and why the Pension Fund's position is unlawful. Depending on the circumstances, the administrative court may satisfy the claims and require the Pension Fund to take specific actions. There are also cases where the court grants the claims only partially. Where there are sufficient legal grounds, the judgment may then be challenged before the court of appeal.

An appeal in a pension case is a procedural mechanism for challenging a judgment or ruling of a court of first instance before the competent appellate administrative court. Our lawyers prepare appeals in pension disputes, analyze the findings of the court of first instance and identify errors in the application of substantive or procedural law. Particular attention is given to those claims and legal arguments that were rejected or insufficiently addressed by the court of first instance.

If the required result is not achieved at the appellate stage and the applicable procedural requirements are satisfied, the next stage may be a cassation appeal to the Supreme Court.

In Ukraine, cassation review of administrative cases is carried out by the Supreme Court. The Supreme Court includes the Administrative Court of Cassation, as well as other cassation courts and the Grand Chamber of the Supreme Court.

A cassation appeal in a pension case is a procedural document through which an eligible party may seek review of a court decision on the grounds provided by procedural law. Cassation proceedings differ significantly from proceedings before the courts of first and appellate instances and are subject to specific procedural requirements and limitations.

Preparing a cassation appeal requires a detailed analysis of the previous court decisions, the applicable provisions of the Code of Administrative Procedure of Ukraine, relevant legislation and the case law of the Supreme Court. It is also necessary to determine whether the case meets the statutory grounds for cassation review. Particular attention must be paid to the procedural deadline for filing the cassation appeal. If the deadline has expired, its renewal may be requested where permitted by law and where there are sufficient grounds for doing so.
