Court Orders Pension Recalculation Based on an Updated Monetary Allowance Certificate

Court Orders the Pension Fund of Ukraine to Recalculate a Former Law Enforcement Officer’s Pension Based on an Updated Certificate of Monetary Allowance

An administrative court issued a judgment in a case concerning the recalculation and payment of a pension for years of service to Anatolii Sidak, a former officer of the internal affairs authorities. The court ordered the Pension Fund of Ukraine to recalculate and pay his pension from 1 December 2019 based on an updated certificate specifying the amount of his monetary allowance.

Anatolii Sidak, a former employee of the internal affairs authorities, filed a lawsuit seeking the recalculation of his pension benefits. He argued that the Pension Fund of Ukraine had unlawfully refused to recalculate his pension.

The court considered the claim and upheld the claimant’s position. Taking into account the updated certificate of monetary allowance submitted in the case, the court ruled in favor of the claimant. The Pension Fund of Ukraine was ordered to recalculate and pay Anatolii Sidak’s pension for the entire period starting from 1 December 2019.

This court judgment demonstrates the importance of protecting citizens’ rights in the field of social security. Pension benefits must be properly calculated and paid taking into account all factors that affect the pension amount. The judgment in this case plays an important role in protecting the right of former law enforcement officers to receive the correct amount of pension for years of service.

As a result of the recalculation, Anatolii Sidak’s monthly pension increased by UAH 5,000.
