Court Challenge of Pension Refusal Due to Unconfirmed Insurance Record

Retirement is a complex process that requires compliance with a number of formal requirements. One of these requirements established by law is that a prospective pensioner must have the required insurance record.

The Pension Fund of Ukraine carefully examines documents confirming a person’s periods of employment. If even minor discrepancies are identified, such as corrections, missing entries, missing stamps, or other deficiencies, the Pension Fund may exclude the relevant periods from the person’s insurance record. As a result, the amount of the pension may be reduced, or the person may be denied a pension altogether. In such cases, one of the most effective ways to protect pension rights is to challenge the Pension Fund’s refusal to grant a pension in court.

Valentyn Krasnov found himself in a similar situation. The Pension Fund refused to include several periods in his insurance record: a period of employment due to the absence of an entry specifying the name of the company where he had been employed; another period of employment due to a correction in the date of the employment order; a period of education confirmed by a diploma due to the absence of the signature of the deputy director for educational and vocational training; a period of entrepreneurial activity from 1993 to 1998 due to the absence of documents confirming the applicable taxation system and payment of contributions; and a period of employment while serving a sentence due to the absence of information confirming the payment of insurance contributions.

After Valentyn Krasnov contacted an attorney from our company, it was decided to challenge the Pension Fund’s refusal to grant him a pension in court. Before filing the lawsuit, the attorney carried out extensive preparatory work, including collecting evidence, obtaining additional documents confirming the disputed periods, and developing the legal arguments necessary to substantiate the client’s position.

Following consideration of the claim, the court found that the evidence collected by the attorney proved that the disputed periods of employment, education, entrepreneurial activity, and employment while serving a sentence had to be taken into account when calculating the claimant’s insurance record.

It is important to emphasize that the successful outcome of this case was achieved through the attorney’s professional expertise and thorough preparation. The ability to clearly substantiate the client’s position before the court proved to be a key factor in resolving the dispute.

Ultimately, this court case demonstrates the importance of professional legal assistance in protecting citizens’ pension rights, ensuring social justice, and securing the pension benefits to which they are legally entitled.
