Court Orders the Pension Fund to Recognize Employment Record and Salary Earned in Russia
The court case challenging the refusal to grant an old-age pension became an important event in the life of Oleksandr Zinkovskyi, who had been denied a pension by the Pension Fund of Ukraine (PFU). The reason for the refusal was the PFU’s failure to include Oleksandr’s period of employment in the Russian Federation in his employment record and its refusal to take into account the salary he had earned there. This case highlights the importance of professional legal representation and proper handling of pension disputes in court.
A key role in this case was played by Yevhenii Promskyi, an attorney at ARES Law Firm – Pension Center, who represented and protected his client’s interests before the court. His professionalism and in-depth understanding of pension legislation helped achieve a favorable outcome. Yevhenii successfully argued that the period of employment in the Russian Federation and the salary earned there had to be taken into account when calculating the pension in accordance with applicable international agreements and Ukrainian legislation.
The first step was to file a lawsuit challenging the decision of the Pension Fund of Ukraine. The attorney collected all the necessary documents confirming the client’s employment in the Russian Federation. He emphasized that during the relevant period of Zinkovskyi’s employment in Russia, international agreements were in force that required the recognition of employment periods and earnings obtained in Russia for pension purposes in Ukraine. The attorney submitted documents confirming both the client’s employment record and the salary he had earned in Russia.
During the court proceedings, Yevhenii Promskyi presented persuasive arguments in support of his client, emphasizing the importance of compliance with international agreements and the protection of citizens’ rights to pension benefits. His professional approach and ability to clearly explain the substance of the dispute to the court became important factors in achieving a positive result.
After examining the evidence submitted by the parties and considering their arguments, the court ruled in favor of the claimant. The Pension Fund of Ukraine’s refusal to grant the old-age pension was found to be unlawful. This judgment confirmed the importance of protecting pension rights and challenging unlawful decisions of the Pension Fund when there are sufficient legal grounds to do so.
As a result of the court proceedings, the client was granted a pension starting from the date on which he had originally submitted his application to the Pension Fund of Ukraine. This case demonstrates the importance of qualified legal assistance in complex matters involving pension entitlement, foreign employment records, and earnings received abroad. Thanks to the professional work and persistence of attorney Yevhenii Promskyi and the team of ARES Law Firm – Pension Center, the client was able to protect his rights and obtain the pension to which he was legally entitled.
Thus, this court case challenging the refusal to grant an old-age pension is a clear example of the importance of reliable legal support and the effective protection of pension rights. ARES Law Firm – Pension Center demonstrated its professional approach by helping its client successfully challenge the Pension Fund’s decision and obtain the pension benefits to which he was entitled.
