Law of Ukraine No. 1058-IV provides that persons who worked in state or municipal institutions in positions specified in paragraphs “e”–“g” of Article 55 of the Law of Ukraine “On Pension Provision” and have the required insurance record may be entitled to a lump-sum payment equal to ten monthly pensions. This payment is an important social guarantee; however, in practice, difficulties often arise when certain periods of employment need to be credited, particularly in the case of persons who held elected positions.
Key Legal Grounds
- Paragraph 7-1 of Section XV of the Law of Ukraine “On Compulsory State Pension Insurance”. The lump-sum payment may be granted to persons who:
- Have reached the statutory retirement age (60 years for men and 58 years for women).
- Have the required insurance record: 35 years for men and 30 years for women.
- Worked in positions entitling them to a pension for years of service under Article 55 of the Law of Ukraine “On Pension Provision”.
- Did not receive any other type of pension before being granted an old-age pension.
- Article 12 of the Law of Ukraine “On Local Self-Government in Ukraine”. Village, settlement and city mayors are entitled to the powers and guarantees provided by law for local council members unless otherwise established by law.
- Article 33 of the Law of Ukraine “On the Status of Local Council Members”. The period during which a local council member works for the council on a permanent basis is included in their overall and continuous employment (service) record, as well as in the employment (service) record in the profession or speciality in which the person worked before being elected to a position in the council.
How It Works in Practice
Employment in elected positions, such as a council secretary, may be included in the relevant special employment record. This is particularly important where, before being elected to such a position, the person worked in a field specified in paragraphs “e”–“g” of Article 55 of the Law of Ukraine “On Pension Provision”. Ukrainian court practice confirms that periods of employment in elected positions in local government bodies may be included in the qualifying employment record that gives a person the right to receive a lump-sum payment equal to ten monthly pensions.
Difficulties in Crediting Employment Periods
The Pension Fund of Ukraine frequently refuses to credit such periods because the relevant elected positions are not formally included in the applicable lists of qualifying positions. In such cases, it may be necessary to challenge the Pension Fund’s decision in court.
