How to Recognize Insurance Record or Preferential Pensionable Service Through Court in Ukraine

The recognition of insurance record or preferential pensionable service is becoming increasingly important for Ukrainian citizens who are preparing for retirement or are already applying for a pension. Due to inconsistencies in employment record books, lost documents, liquidation of enterprises or improper maintenance of employment records, many people face situations where the Pension Fund of Ukraine refuses to include certain periods of employment in their pensionable service. In such cases, one of the most effective ways to protect pension rights is to challenge the Pension Fund’s decision in court and seek recognition of the relevant periods as insurance record or preferential pensionable service.

Insurance record is the period during which a person was covered by compulsory state pension insurance and for which the required insurance contributions were paid. For periods after the introduction of the compulsory state pension insurance system in 2004, insurance record is one of the key factors determining entitlement to an old-age pension.

Preferential pensionable service includes periods of employment under conditions that entitle a person to an old-age pension on preferential terms, for example, work performed under harmful, hazardous or particularly difficult working conditions. The relevant occupations, positions and types of work are determined by Ukrainian legislation.

The Pension Fund of Ukraine may refuse to include the following periods in a person’s pensionable service:

  • periods of employment for which the relevant information is missing from the Register of Insured Persons;
  • periods of employment at enterprises that have subsequently been liquidated;
  • periods for which primary employment documents are unavailable or have been lost;
  • preferential periods where the specific working conditions have not been properly confirmed.

In such situations, a person has the right to challenge the Pension Fund’s refusal and seek recognition of the relevant periods of employment on the basis of the available evidence.

From a legal perspective, the procedure generally works as follows: the applicant receives a decision from the Pension Fund of Ukraine refusing to grant a pension or refusing to include certain periods of employment in the insurance record or preferential pensionable service. The applicant may then file an administrative claim challenging the PFU’s decision and request that the court require the Pension Fund to include the disputed periods in the person’s pensionable service.

Evidence confirming periods of employment may include:

  • an employment record book;
  • archival certificates and extracts;
  • testimony of former colleagues where such evidence is permitted by law;
  • copies of employment orders and working-time records;
  • other documents confirming the fact and duration of employment.

When preferential pensionable service is concerned, particular importance may be attached to workplace certification documents, documents describing working conditions, records confirming harmful or hazardous working conditions and other evidence required by the applicable pension legislation.

At the same time, where an applicant has an employment record book containing properly completed entries that reliably confirm the relevant periods of employment, the Pension Fund cannot disregard such information merely because additional documents are unavailable without sufficient legal grounds.

After a favorable court judgment enters into force, the Pension Fund must comply with the court’s decision and, depending on the relief granted, include the relevant periods in the applicant’s insurance record or preferential pensionable service when determining pension rights.

A court judgment can be an effective legal instrument for restoring pension rights and requiring the Pension Fund to reconsider its decision or include the disputed periods of employment.
