Preferential Pension for Chemical Analysis Laboratory Technicians in Ukraine

In industry, many occupations involve exposure to harmful factors that may affect workers’ health. This is particularly relevant to the chemical industry, where daily work with reagents, acids, alkalis, and other hazardous substances may lead to occupational diseases. One such occupation is that of a chemical analysis laboratory technician working in a chemical laboratory, particularly in the spinning and finishing department of textile enterprises. In this article, we will examine the pension rights of such employees, focusing on the possibility of early retirement due to work performed under particularly harmful and particularly difficult working conditions. We will analyze the applicable legal framework, occupational classification criteria, and examples of court practice to provide a comprehensive overview of the issue.

In Ukraine, pension legislation regulates early retirement for employees engaged in work under harmful working conditions. The principal legislative act is the Law of Ukraine “On Compulsory State Pension Insurance” No. 1058-IV dated 9 July 2003. Pursuant to Article 114 of this Law, persons who have worked in positions included in special lists are entitled to an old-age pension on preferential terms.

There are two key lists of occupations approved by Resolution of the Cabinet of Ministers of Ukraine No. 461 dated 24 June 2016 “On Approval of the Lists of Industries, Works, Professions, Positions and Indicators, Employment in Which Entitles a Person to an Old-Age Pension on Preferential Terms”:

  • List No. 1. This list includes industries, types of work, professions, and positions involving particularly harmful and particularly difficult working conditions. Men are entitled to retire at the age of 50 provided they have at least 25 years of insurance record, including at least 10 years of employment in such conditions. Women are entitled to retire at the age of 50 provided they have 20 years of insurance record, including at least 7 years and 6 months of employment under harmful working conditions.
  • List No. 2. This list covers work involving harmful and difficult working conditions. Men are entitled to retire at the age of 55 provided they have 30 years of insurance record, including at least 12 years and 6 months of employment under harmful working conditions. Women are entitled to retire at the age of 55 provided they have 25 years of insurance record, including at least 10 years of employment under harmful working conditions.

For employees of chemical laboratories, the key harmful factors include exposure to chemicals, vapors, aerosols, noise, vibration, and other hazardous factors. Workplace certification should document any exceedance of the maximum permissible concentrations (MPCs) of harmful substances, which may provide grounds for including the relevant period of employment in the preferential service record.

The spinning and finishing department is part of textile production where fibers are processed, dyed, finished, and subjected to other processes involving the use of chemicals. A chemical analysis laboratory technician working in the chemical laboratory of such a department is responsible for quality control of raw materials, semi-finished products, and finished products. Their duties may include:

  • Performing chemical analyses of samples (for example, determining acidity, alkalinity, and dye content).
  • Working with reagents, including acids (sulfuric acid, hydrochloric acid), alkalis (sodium hydroxide), and organic solvents (benzene, toluene).
  • Using laboratory equipment, including titrators and spectrophotometers, which may involve exposure to electromagnetic fields.

Such working conditions are often classified as harmful due to continuous contact with toxic substances that may cause poisoning, allergic reactions, respiratory diseases, or skin conditions. List No. 1, under the section “Chemical Production,” includes occupations associated with the production of dyes, acids, and alkalis. Although a laboratory technician may not be directly involved in the production process, work in the laboratory of a production department may qualify as harmful if workplace certification confirms that the applicable exposure limits have been exceeded.

List No. 2, under the section “Textile Industry,” includes occupations in spinning and weaving departments involving exposure to dust, noise, and chemicals. A chemical analysis laboratory technician may fall within the category of “chemical laboratory technicians in industries with harmful working conditions” if particularly hazardous substances, such as chromium compounds or formaldehyde, are used in the textile finishing process.

To confirm preferential service, the following documents are required: an employment record book containing an accurate description of the position (“chemical analysis laboratory technician of the chemical laboratory of the spinning and finishing department”), workplace certification orders, working conditions assessment records, and a certificate issued in accordance with Appendix 5 to Resolution of the Cabinet of Ministers of Ukraine No. 637. If the Pension Fund of Ukraine (PFU) refuses to recognize the relevant period of employment, the employee has the right to challenge such a decision in court.

Court practice demonstrates that employees frequently apply to the courts to establish their entitlement to a preferential pension where the PFU fails to take into account the specific nature of their position. For example, in the court decision available at https://www.reyestr.court.gov.ua/Review/134064086, the court considered a case involving a chemical analysis laboratory technician working in the chemical laboratory of a spinning and finishing department. The court took into account that the work was associated with particularly harmful working conditions because it involved contact with toxic substances used in textile production. It should be noted that the key arguments included references to List No. 1, workplace certification, and evidence concerning the actual working conditions. The court ordered the PFU to recalculate the pension taking into account the preferential service record.

Similar cases demonstrate that courts apply an individual approach: even where a particular position is not expressly listed, the relevant period of employment may be included in the preferential service record if the actual working conditions meet the applicable criteria, such as exceeding maximum permissible concentrations and continuous exposure to harmful factors.

Common mistakes made by the PFU include failure to take into account periods of employment during the Soviet era (before 1991), when different lists were in force or workplace certifications were disregarded.

In conclusion, the occupation of a chemical analysis laboratory technician working in the chemical laboratory of a spinning and finishing department may provide grounds for early retirement due to employment under particularly harmful working conditions. Ukrainian legislation protects the rights of such employees, while court practice confirms the possibility of successfully challenging refusals. It is important to properly document both the employment period and working conditions in a timely manner in order to avoid difficulties when applying for a pension.
