How to Restore a Ukrainian Pension While Living in Australia

The restoration of a Ukrainian pension remains a highly relevant issue, particularly following the outbreak of the full-scale war, when many pensioners were forced to leave Ukraine. This also applies to the restoration of Ukrainian pensions for residents of Australia. Although Ukrainian law guarantees the right to pension benefits regardless of a person's place of residence, exercising this right in practice is often complicated by formal requirements and bureaucratic obstacles.

The Law of Ukraine "On Mandatory State Pension Insurance" expressly provides that if a pension is not received for six consecutive months, its payment shall be suspended. As a result, the most common problem arises when a pensioner does not receive pension payments for six months, prompting the Pension Fund of Ukraine (PFU) to suspend further payments. For Ukrainian pensioners living in Australia, the situation is even more complicated because they are unable to physically interact with Ukrainian banks or postal service providers.

To resolve this issue, a pensioner must submit an application to the Pension Fund of Ukraine requesting the restoration of pension payments. However, such applications are frequently rejected. Today, Ukrainian courts are considering a significant number of cases in which pensioners challenge PFU decisions refusing to restore their pensions. An analysis of these cases reveals the most common mistakes applicants make, which often result in unfavorable court decisions.

First, applicants often submit an incomplete set of documents. Under the applicable procedure, in addition to a passport and taxpayer identification number, the applicant must provide documentary proof that they are alive, as well as documents confirming temporary protection or refugee status. In many cases, pensioners submit only their passport and tax identification number.

Second, documents are submitted without proper consular legalization or notarization. Certification of documents is a mandatory requirement for restoring pension payments.

Third, applicants submit documents drafted in a foreign language without the required Ukrainian translations. Ukrainian legislation requires that all foreign-language documents be accompanied by officially certified translations into Ukrainian.

Therefore, the main issue is not the absence of the right to have pension payments restored, but rather non-compliance with the required procedure. A refusal to restore pension payments may be entirely lawful if the applicant fails to meet the documentary requirements or properly prepare the required documents. Pensioners should therefore pay close attention to the correct preparation and certification of all documentation to ensure uninterrupted pension payments. Full compliance with the applicable procedures enables Ukrainian citizens to exercise their constitutional right to social security and continue receiving their pension even while residing outside Ukraine.
