How to Receive the Unpaid Pension of a Deceased Husband in Ukraine
Today, we will discuss how to receive the pension payments of a deceased husband in Ukraine. This issue is particularly relevant for families who need to determine what happens to pension amounts that had been accrued to a pensioner but remained unpaid at the time of death. Under Ukrainian pension legislation, such amounts may be paid to eligible family members of the deceased or, in certain circumstances, become part of the deceased person’s estate.
An application for payment of the pension amount that remained unpaid due to the pensioner’s death may be submitted personally, through an authorised representative, or by other means permitted by law. If documents are submitted through a representative, the representative must have appropriate authority. When documents are sent remotely, it is important to provide the complete set of documents required for consideration of the application.
What documents can confirm a family relationship with the deceased? Depending on the circumstances, these may include a passport, birth certificate, marriage certificate, documents confirming family composition or other official documents. In certain cases, a court decision may also be used to establish the relevant legal fact.
It may also be necessary to confirm that the applicant lived together with the deceased pensioner on the date of death. Such circumstances can be confirmed by documents issued by the competent authorities or other documents accepted in accordance with Ukrainian legislation.
Another important point should be taken into account. If no eligible family member applies for the unpaid pension within the period established by law, or if there are no such family members, the unpaid pension amount becomes part of the inheritance and may be received by the heirs according to the general inheritance procedure.
Step-by-step instructions on how to receive the unpaid pension of a deceased pensioner:
1. Submit an application for payment of the pension amount that remained unpaid due to the pensioner’s death to the Pension Fund of Ukraine.
2. Submit the required documents. Depending on the circumstances, these may include the applicant’s passport, the pensioner’s death certificate, documents confirming the family relationship with the deceased, documents confirming cohabitation with the deceased and, where applicable, a power of attorney or another document confirming the representative’s authority.
3. After the Pension Fund reviews the application and confirms the applicant’s right to receive the unpaid pension, the relevant amount is paid in accordance with the procedure established by Ukrainian legislation.
How can you receive the unpaid pension as an inheritance?
If the unpaid pension amount has become part of the deceased pensioner’s estate, it is inherited according to the general rules of inheritance law. The heir should contact a notary and complete the inheritance procedure within the period established by law. After obtaining the documents confirming the right to inheritance, the heir may apply for payment of the relevant pension amount.
It is important to distinguish between receiving an unpaid pension as an eligible family member and receiving it as part of an inheritance. These are different legal procedures, and the required documents and deadlines may differ depending on the circumstances.
Therefore, if a pensioner dies without receiving pension payments that had already been accrued, these funds are not automatically lost. Eligible family members may receive them under the special procedure established by pension legislation, while in other cases the unpaid amount may become part of the inheritance.
