Military Disability Pension in Ukraine: How to Apply

Since the beginning of the full-scale invasion of Ukraine by the Russian Federation, Ukrainian servicemembers have played a crucial role in protecting the sovereignty and territorial integrity of the country. From a legal perspective, one of the most important issues is ensuring proper social protection for servicemembers. This article focuses on military pensions in Ukraine, including the types of pensions available to servicemembers, disability pensions, pension amounts and the documents that may be required to apply for a military disability pension.

Unlike certain other types of pensions, entitlement to a military disability pension does not necessarily depend on the length of the person’s insurance record. The circumstances and timing in which the disability arose are particularly important. Ukrainian legislation provides for a disability pension where the disability occurred during military service or, subject to the statutory conditions, after discharge from service where the disability resulted from an illness, injury, contusion or other health condition connected with military service.

The cause of disability and its connection with military service are essential for determining both entitlement to a pension and its amount. The competent authorities assess the person’s health condition, degree of loss of functioning and the causal connection between the disability and military service.

For pension purposes, servicemembers with disabilities may fall into different categories depending on the cause of the disability, including:

1.      Persons whose disability resulted from war-related injuries, wounds, contusions or other circumstances specified by law.

2.      Persons whose disability resulted from an illness, injury or other health condition connected with military service but falling within another statutory category.

Particular attention should be paid to the amount of a military disability pension. The percentage used to calculate the pension depends on the disability group, the cause of disability and the category to which the servicemember belongs. For persons with a war-related disability, the legislation provides for higher pension percentages than for certain other categories of servicemembers with disabilities. The final pension amount is determined on the basis of the servicemember’s monetary allowance and the percentage established by law for the relevant category.

Once the general eligibility requirements are understood, the next question is how a servicemember can apply for a pension and what documents are required when applying for a disability pension.

Depending on the category of servicemember and the applicable pension procedure, the application is submitted together with the documents required by Ukrainian legislation. The principal documents may include:

• An application for a pension completed in accordance with the applicable procedure.
• A passport or ID card and, where necessary, a document confirming the person’s registered place of residence.
• Taxpayer identification number.
• Employment and service documents required to confirm periods of employment and military service.
• Documents confirming the disability, its cause and its connection with military service, as well as documents confirming any special legal status of the applicant.
• Other documents required for the particular type of military pension and the individual circumstances of the applicant.

For certain categories of servicemembers, including persons who performed compulsory military service, additional medical and military documents may be required. These may include a certificate of illness, a conclusion of the military medical commission or other documents establishing the causal connection between the health condition and military service.
