Preferential Pension for Synthesis Process Operators under List No. 1

Ukrainian legislation regulates the procedure for granting pensions in detail. However, due to the complexity of pension legislation and the large number of applicable legal provisions, not everyone is familiar with the general rules and procedure for obtaining a pension in Ukraine.

As a general rule, entitlement to an old-age pension depends on two principal conditions:

  1. reaching the statutory retirement age;
  2. having the required period of insurance coverage.

However, Ukrainian legislation provides preferential retirement conditions for certain occupations. These benefits are associated with the harmful or particularly harmful effects of specific working conditions on employees' health. Such occupations include synthesis process operators engaged in the manufacture of polyester-urethane rollers.

A synthesis process operator performs one or more chemical stages of the technological synthesis process and related operations required to obtain intermediate materials or finished products. Due to the nature of such work and exposure to harmful production factors, certain periods of employment may qualify as preferential pensionable service.

Accordingly, a synthesis process operator may be entitled to an old-age pension on preferential terms if the statutory requirements concerning age, total insurance record and the required period of employment under harmful working conditions are satisfied.

In particular, where the relevant employment falls within List No. 1, the right to preferential retirement depends on the legislation applicable during the particular period of employment, the exact job title, the nature of the work performed and the duration of preferential pensionable service.

In addition to satisfying the statutory requirements, an applicant must properly confirm the relevant preferential employment record. As a general rule, the necessary information concerning employment periods and positions is contained in the employment record book.

However, employment record books may contain incomplete entries, inaccuracies, corrections or may lack information necessary to establish the preferential nature of the work. In such circumstances, it may be necessary to obtain a clarifying certificate from the employer, its legal successor or the relevant archive.

In practice, the Pension Fund of Ukraine may request such a certificate even where the employment record book already contains sufficient information confirming the employee's position and period of employment. If the applicant fails to provide the requested certificate, the Pension Fund may refuse to count the relevant period towards preferential pensionable service and consequently refuse to grant the pension.

A refusal in such circumstances does not necessarily mean that the applicant has lost the right to a preferential pension. The first step is to analyse the Pension Fund's refusal, independently or with the assistance of a pension lawyer, and determine whether there are grounds for challenging the decision before an administrative court.

The case law of the Supreme Court may be particularly important in such disputes. Ukrainian courts have repeatedly considered cases in which the Pension Fund demanded additional documents despite the existence of relevant information in an employment record book. Formal deficiencies or the inability to obtain additional documentation should not automatically deprive an employee of pension rights where the relevant employment circumstances can be established on the basis of other admissible evidence.

Therefore, a refusal to grant a preferential pension to a synthesis process operator is not necessarily final and may be challenged in court. Before filing a claim, it is advisable to analyse the employment record book, archival documents, clarifying certificates, workplace certification documents and the Pension Fund's decision in order to determine the most effective way to protect the applicant's pension rights.
