Preferential Pension for Hot-Dip Tinning Operators under List No. 1

Applying for a pension can be a complex process involving the collection and submission of a considerable number of documents. The exact list of documents depends primarily on the type of pension for which a person is applying.

The procedure is generally simpler for individuals applying for a standard old-age pension. To qualify, a person must reach the statutory retirement age and have the required period of insurance coverage. The standard package of documents usually includes identification documents, information confirming insurance coverage and employment history, and other documents required by the Pension Fund of Ukraine.

However, Ukrainian legislation provides preferential retirement conditions for certain occupations involving harmful or particularly harmful working conditions. Such occupations include hot-dip tinning operators engaged in tinning products with lead-containing solders, as well as solders containing hazardous substances of hazard classes 1–2 or carcinogens.

A hot-dip tinning operator performs, in particular, the following duties:

  • operates the continuous tinplate tinning process on tinning lines;
  • regulates the intensity and temperature of heating tin and oil in the tinning equipment;
  • sets and adjusts the rotation speed of the upper and lower rollers of the relevant equipment;
  • monitors the quality of tinplate pickling in the pickling unit integrated into the production line;
  • sets up and adjusts tinning equipment.

Employment as a hot-dip tinning operator under the conditions specified by Ukrainian legislation may qualify as work under List No. 1. This may entitle an employee to an old-age pension on preferential terms before reaching the general retirement age.

Eligibility for such a pension depends on several factors, including the employee's age, total insurance record, duration of preferential pensionable service, exact job title, working conditions and the legislation applicable during the relevant periods of employment.

In addition to the documents required for a standard old-age pension, applicants for a List No. 1 preferential pension may need to provide documents confirming the preferential nature of their employment. One of the principal documents confirming employment history is the employment record book.

Where the employment record book contains sufficient information about the position, period of employment and nature of the work, it may serve as important evidence of the relevant employment period. If the entries are incomplete or do not contain information necessary to determine whether the work qualifies for preferential pension treatment, an additional clarifying certificate from the employer, its legal successor or an archive may be required.

In practice, the Pension Fund of Ukraine may sometimes request additional certificates even where the applicant believes that the employment record book contains sufficient information. Problems arise when the enterprise has been liquidated, documents have not been transferred to an archive or it is otherwise impossible to obtain the requested certificate.

If the Pension Fund refuses to include the relevant employment period in preferential pensionable service and consequently refuses to grant a pension, such a decision does not necessarily mean that the applicant has no right to preferential retirement. The legality of the refusal and the available evidence should be carefully analysed.

Disputes concerning confirmation of preferential service have repeatedly been considered by Ukrainian administrative courts, including the Supreme Court. Judicial practice confirms the importance of assessing all available evidence rather than relying exclusively on formal deficiencies in individual documents.

Therefore, if a hot-dip tinning operator is refused a preferential pension, the Pension Fund's decision may be challenged before an administrative court. Before filing a claim, it is advisable to analyse the employment record book, clarifying and archival certificates, workplace certification documents and other evidence confirming the nature and duration of the applicant's employment.
